CJI's rebuke...this is a court, not a coffee shop, know the whole matter

Supreme Court CJI Reprimand: During the hearing of a case in the Supreme Court on Monday, Chief Justice DY Chandrachud reprimanded a lawyer for inappropriate use of language. The lawyer repeatedly used the word ‘Yes’, which was not in keeping with the dignity of the court. Expressing his displeasure on this, the CJI said, this is a court, not a coffee shop. After the Chief Justice’s stern reaction, the lawyer started speaking in Marathi. This incident underlines the importance of maintaining discipline and decorum of language in the court.

Know what is the whole matter

The Supreme Court was hearing a 2018 petition, which was filed by a lawyer. In this petition, the lawyer had made former Chief Justice Justice Ranjan Gogoi a defendant. During the hearing, Chief Justice DY Chandrachud expressed surprise and asked, is this a petition under Article 32? How do you file a petition naming a judge as the defendant? (Supreme Court CJI Reprimand)

Under Article 32, Indian citizens can directly appeal to the Supreme Court in case of violation of their fundamental rights. When the lawyer was questioned on this, he replied, yes, the then Chief Justice Ranjan Gogoi has been made a defendant in this. I was asked to file a corrective petition.

Chief Justice reprimanded

During the hearing, Chief Justice DY Chandrachud got angry when the lawyer said Ya ya and gave a strong reaction saying, this is not a coffee shop, what is this Ya ya… I hate this word. This cannot be allowed in court. He also made it clear to the lawyer that Justice Ranjan Gogoi is a former judge of this court, and you cannot file such a petition demanding an internal inquiry against the judge.

This cannot be done just because the previous bench did not accept your petition. The CJI then said that the Registry Department would take a decision on listing the petition, and he directed the petitioner to remove Justice Gogoi’s name from the petition, as he is now a member of the Rajya Sabha.
