Supreme Court of India Bans Bulldozer Action?

New Delhi. The Supreme Court has banned bulldozer action. The Supreme Court has said that for the next 15 days, i.e. till October 1, bulldozers will not be used on anyone’s house or shop anywhere in the country. However, the court made it clear that if there is encroachment on the road, footpath or railway line, then there is no ban on removing it. The Supreme Court will hear this matter on October 1. While hearing this on Tuesday, September 17, the Supreme Court said that it will make rules regarding the use of bulldozers. Expressing displeasure, the court also said that officers cannot become judges.

The central government questioned this order of the Supreme Court. Solicitor General Tushar Mehta said that the hands of constitutional institutions cannot be tied like this. On this, the bench of Justice BR Gavai and Justice KV Vishwanathan said – If the action is stopped for two weeks, the sky will not fall. You stop it, what will happen in 15 days? The central government also said that an impression is being made about the bulldozer action. On this the judges said – the court is not influenced by impressions, we are making it clear that we will not come in the way of any illegal encroachment, but officers cannot become judges.

Actually, during the hearing, Jamiat-e-Ulama-e-Hind said that bulldozer action is being taken against people of the minority community. On this, the Supreme Court said that bulldozer action has been taken in Madhya Pradesh, in which 70 shops were demolished. Out of these, 50 shops belong to Hindus. The Center further said that an impression is being created about this action. On this, the Supreme Court said – We are not affected by external noise. Right now we are not going to the point that on which community action is being taken. If there is even one illegal bulldozer action, then it is against the Constitution.

The Supreme Court further said that the matter will be heard on October 1, till then there should not be any vandalism in the country. Questioning this order, the central government said that the hands of constitutional institutions should not be tied like this. Then the Supreme Court said that if action is not taken in two weeks, the sky will not fall. You stop your hands. What will happen in 15 days.

Earlier, on September 12, the Supreme Court had also said that bulldozer action is like running a bulldozer on the laws of the country. The case was in the bench of Justice Hrishikesh Roy, Justice Sudhanshu Dhulia and Justice SVN Bhatti. Actually, a family was threatened with bulldozer action by the municipality in Gujarat. The petitioner is the co-owner of a land in Kathlal of Kheda district.
