New Delhi. The Supreme Court has refused to reconsider the decision on classification in SC reservation. He has rejected all the petitions filed for reconsideration of this decision. With this, the way has been cleared for the state governments to classify the Scheduled Castes i.e. SC in the reservation i.e. to give quota within the quota. The seven-judge Constitution bench of the Supreme Court on Friday rejected the review petitions filed against it.
The bench of Chief Justice DY Chandrachud, Justice BR Gavai, Justice Vikram Nath, Justice Bela Trivedi, Justice Pankaj Mittal, Justice Manoj Mishra and Justice Satish Chandra Sharma said – there is no such flaw in the old decision, which should be reconsidered. . In the review petitions, no basis has been given to reject the decision given by the Supreme Court on December 1. Therefore the review petitions are dismissed.
It is noteworthy that the Supreme Court had ruled on August 1 that the state governments will now be able to give quota within the quota in the reservation of Scheduled Castes, i.e. SC. The court overturned its own 20 year old decision. 20 years ago the court had said that Scheduled Castes are a homogeneous group and cannot be further divided on the basis of castes included in it. In its new decision, the court also gave necessary instructions to the states and said that the state governments cannot take decisions arbitrarily.
