New Delhi. In an important decision, the Supreme Court has stayed the order to close madrassas. Actually, a hearing was held in the Supreme Court on Monday regarding Madrassas, in which the Supreme Court gave two orders. The Supreme Court stayed the decision of the central and state governments to close madrassas. In fact, the National Commission for Protection of Child Rights, NCPCR, had made recommendations related to this to the states on June 7 and June 25. The Center supported this and asked the states to take action on this.

In the second decision, the Supreme Court also stayed the order of Uttar Pradesh and Tripura governments, in which students studying in madrassas were to be transferred to government schools. This includes non-Muslim students studying in unrecognized madrassas as well as government-aided madrassas. The bench of Chief Justice DY Chandrachud, Justice JB Pardiwala and Justice Manoj Mishra gave these decisions while hearing the petition of Jamiat Ulema-e-Hind.

The Supreme Court has issued notices to the Central Government, NCPCR and all the states, seeking their response within four weeks. The court said that this stay is interim. Until a decision is taken on the matter, the state will not be able to take any action against madrassas. The court allowed Jamiat Ulema-e-Hind to make Uttar Pradesh and Tripura and other states also parties to the petition.

In fact, the National Commission for Protection of Child Rights, NCPCR, had said on October 12 that the recognition of madrassas that do not comply with the Right to Education Act 2009 should be canceled and they should be investigated. NCPCR had written a letter to all the states saying that the funds given to madrassas should be stopped as they do not follow the rules of the Right to Education Act.
