Supreme Court's big decision on child marriage

New Delhi. The Supreme Court has made important comments regarding child marriage. The court delivered its verdict on Friday, October 18, 2024, on a petition related to child marriage cases in the country. The Supreme Court has said that it is not right for the law prohibiting child marriage to be affected due to personal law. The court has said that early marriage deprives people of the right to choose a life partner of their choice.

Along with this, the Supreme Court also said that the issue of placing the Child Marriage Prohibition Act above personal law is pending with the Parliamentary Committee. So, he is not commenting much on it. The Supreme Court, while giving its verdict on the petition of an NGO, gave several instructions regarding the control of child marriage. In this petition it was said that despite the ban on child marriage, it continues in the country even today.

While delivering the verdict, the bench of Chief Justice DY Chandrachud, Justice JB Pardiwala and Justice Manoj Mishra said – We need awareness to stop child marriage, mere provision of punishment will do nothing. Chief Justice said- We saw and understood the objective of the law made on prevention of child marriage. There is a provision of giving punishment without any harm, which proved ineffective. We need awareness campaign. It is noteworthy that the Supreme Court had reserved the decision after the hearing on July 10.
