This time, after the results of the Lok Sabha elections, the morale of the opposition parties has returned and questions are being asked of the government in the media as well. But a big change is visible in the activism of the courts. However, even before the elections, the Supreme Court had given such decisions in many cases including electoral bonds, which made the government uncomfortable. It may be a coincidence, but after the election results, the frequency of such decisions has increased. However, the Supreme Court had expressed displeasure over a statement by Telangana Chief Minister Revanth Reddy and said that the decisions of the court are not influenced by politics. However, the Supreme Court and the High Courts in different states have given many such decisions or made many such comments, which have made the government uncomfortable and the opposition has got an opportunity.
The comment made by the Supreme Court regarding the appointment of judges is a warning to the government. Chief Justice DY Chandrachud said that the Supreme Court collegium is not a search committee that its recommendations can be stopped. Keep in mind that the Supreme Court has again sent the recommendation of names for the appointment of judges in many High Courts. It is a rule that when the name is sent again, it has to be approved. But the government has delayed that too. So the Supreme Court has asked to make a list of such names, which have been sent again and the government has stopped the approval. Similarly, the Supreme Court has expressed very strong displeasure over the CBI’s petition to get the West Bengal election violence case heard in the court of another state. The court said that the CBI is questioning the entire judiciary. After the court’s displeasure, the CBI had to withdraw the petition. On the other hand, the Bombay High Court gave the biggest blow to the central government. It called the changes made in the Information and Technology Act i.e. IT Act unconstitutional and cancelled it. This means that the government will no longer be able to create a fact check unit. The High Court has called the changes made by the government a violation of the fundamental rights of citizens. The government will go to the Supreme Court in this matter, but the Supreme Court itself stopped the notification of forming a fact check unit and said that the government cannot form it until the decision of the Bombay High Court comes.
