New Delhi. The Supreme Court on Wednesday heard the petitions filed against the bulldozer action. During this, the verdict was given on Bulldozer Justice. Said this is unconstitutional. The top court said that the rule of law ensures that people should know that their property cannot be taken away without any reason. The Supreme Court has termed the bulldozer action against the culprits as unconstitutional and illegal. Along with this, the court has also set guidelines regarding bulldozer action. In which it has been made clear that if the guidelines are violated, strict action will be taken against the concerned officials. The Supreme Court said that home is everyone’s dream and that dream should not be broken. The right to housing is a fundamental right of everyone. Notice should be given before bulldozer action. Only after this further action should be taken. The court said that no action should be taken within 15 days of the notice. Meanwhile, the party concerned should be given adequate opportunity to present his case. The court said that if bulldozer action is taken without following the prescribed procedure, then damages will also be recovered from the concerned authorities. The bench of Justice BR Gavai and Justice KV Vishwanathan said that the house of any accused cannot be demolished on the ground that the person concerned is from a criminal background.
Such action is completely unconstitutional and illegal. The top court said that if someone’s property is being demolished merely because he has a criminal background, then it is completely unconstitutional. The executive cannot decide who is guilty. He cannot become a judge and decide who should be punished and who should not. Such action is a complete crossing of the Lakshman Rekha, which cannot be accepted at any cost. The Apex Court said that such action by the executive amounts to taking the law into its own hands, which is not appropriate in any respect. While hearing the petition filed in connection with the bulldozer action, the Supreme Court said that if the executive demolishes a person’s house merely on the basis of some allegation, then it will definitely be a big attack on the principle of law. The executive is not a judge who can give a decision to demolish any person’s property. The top court said the action of bulldozers amounts to collective punishment to the family of the accused or the convict and when someone’s property is demolished on a selective basis, it appears to be mala fide. The top court said that demolition action should not be taken without giving show cause notice.
